General rental conditions

General rental conditions: 

These general rental conditions apply to reservations and agreements with regard to the holiday home 'Holiday-Andina', located at 28 Rue du Parc - Hotton - Province of Luxembourg (Belgium). In these general rental conditions, the term 'tenant' is understood to mean: a natural person or a legal person who concludes an agreement with us regarding the rental of the holiday home. These general terms and conditions apply regardless of your (prior) reference to any of your own terms and conditions or to other general terms and conditions. We reject all terms and conditions to which you refer or which are used by you. Agreements deviating from these general terms and conditions are only valid if agreed in writing. 

1. Reservation. 
We only handle reservations from people who are 18 years or older. Reservations by persons younger than that age are therefore not valid. After you have made a reservation, you will receive a confirmation from us and the rental agreement in which the general rental conditions are stated within 5 days. We request that you inform us immediately of any inaccuracies in the rental agreement. By returning this signed document, you confirm that you have read and agree to the general rental conditions. If you have not received a confirmation of receipt from us within 10 days of making the reservation, we request that you contact us immediately, otherwise the reservation cannot be invoked. An agreement is concluded between you and us when we have confirmed the reservation to you. The agreement concerns the rental of the holiday home for recreational use, which by its nature is of short duration. 

2. Payment.
We request that you transfer 50% of the rent to us within 14 days after the date of the lease. The remaining 50% must be paid together with the rental deposit (€ 1000) 6 weeks before the arrival date. If your reservation is within 6 weeks before the arrival date, you must transfer the full amount together with the rental deposit to us upon receipt of the rental agreement. The down payment and / or payment must be transferred to IBAN: BE92 0636 6083 0723 in the name of Eylenbosch - Eylenbosch with the specified reference. The rental ends automatically after the agreed rental period has expired. In case of late payment of the amounts invoiced to you, you will be in default immediately after expiry of the payment term. In that case we reserve the right to cancel your reservation and to dissolve the agreement. 

3. Guarantee. 
The deposit amounts to € 1000. The deposit serves to guarantee damage and / or costs - in the broadest sense of the word - that we may suffer in the event of non-compliance with the obligations of the tenant as a good tenant and the person (s) who accompany the tenant. The deposit must be paid together with the second down payment of the rent. In the event that the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to dissolve the agreement with immediate effect. After settlement of claims (damage to inventory / holiday home and / or other costs) from us to the tenant, the deposit or any remainder thereof will be refunded to the tenant within 14 days after departure. Any (further) claims for compensation will not be canceled by this refund. 

4. Receipt key.
One week before the arrival date, the tenant will receive the code to unlock the front door by email or text message and after payment of the full rental amount. The key will be handed over to him on the spot at the time of arrival. This code may not be transferred. The tenant is never entitled to keep or duplicate the keys for any reason. Should the tenant nevertheless do so, the tenant will owe a fine of € 1000, without prejudice to the actual costs. The keys and remote controls of the holiday home are made available to the tenant on loan by us. The keys and remote controls remain our property. In the event of loss, theft or any other way of losing a key, the tenant owes an amount of € 100 per lost item. For the remote control this comes to € 250 / piece. All costs that arise because you do not deliver the house on time will be recovered from you. We will keep goods that are found after your departure for you for one month, but we do not take any responsibility for this. 

5. Cancellation. 
Cancellation by the tenant must always be made in writing (by post or e-mail). The following rules apply: - Down payments will not be returned in case of cancellation. - If canceled up to 28 days before the day of arrival, 50% of the rent will be charged. - If canceled up to 7 days before the day of arrival, 75% of the rent will be charged. - In case of cancellation from 7 days up to the day of arrival, 100% of the rent is due. If you have not arrived within 24 hours after the agreed date without further notice, this will be considered a cancellation and 100% of the rent is due. In case of cancellation on our part, any monies already paid will be refunded. 

6. Stay in the holiday home. 
Weekend: Friday from 4 p.m. to Sunday 4 p.m. 
Extended weekend: from Friday from 4 pm to Monday 10 am. 
Midweek: Monday from 4 p.m. to Friday 10 a.m. 
Week: Friday to Friday or Monday to Monday. 
Arrival at 4 pm and departure at 10 am. 

The rent does not include final cleaning, bath towels (bathroom and swimming pool) and tourist tax. The holiday home is non-smoking. Smoking is allowed outside on the terrace. No open fire may be used outside. Frying with fat in and around the house is not allowed. Barbecuing with the existing BBQ is allowed (this must be left clean before leaving the house). Moving cabinets and beds, as well as sound or television equipment or taking any part of the indoor inventory outside with you - except of course crockery, glasses and cutlery for your meal outside - is expressly not permitted. Swimming pool rules: It is not allowed to drink or eat in the pool. If you have a drink at the pool, you must use the plastic glasses provided. If you apply sun cream, wait half an hour before going into the pool. The metal balustrade is not allowed to sit or jump from. The premature termination of the lease will be effected immediately in the event of: - subletting or reselling; - bringing pets is not allowed; - More people staying in a holiday home than agreed on the reservation, or a maximum of 12 people applicable to the house is expressly not permitted without our permission, unless otherwise agreed in writing; - organizing student parties, bachelor parties and / or drinking parties; - setting off fireworks; - nuisance to the neighbors; - serious neglect of the duty of care for the holiday home. In such a case, the tenant is not entitled to a refund of the rent and the tenant is obliged to compensate the damage suffered by the landlord as a result of the tenant's acts or omissions. 

7. Liability / complaints / damage. 
The tenant is liable to the landlord for all loss and / or damage to the house, the inventory and all matters belonging to the rented object, which arises for the landlord during the rental period of the holiday home as a result of the stay, regardless of whether this damage was caused by acts or omissions of the tenant and / or co-tenants, or by third parties who are in the holiday home through their actions, or an item in their possession. We therefore recommend that you thoroughly inspect the holiday home and inventory for defects and shortcomings upon arrival. If you discover damage or defects, you must report this immediately in writing by e-mail to info@vakantiehuis-andina.be. We do not accept any liability for theft, loss or damage of or to objects and persons, of whatever nature, during or as a result of the stay in the holiday home. We do not accept any liability for construction activities on the access and main roads, etc. in the vicinity of the rented holiday home. We do not accept any liability in the event of the failure or inoperative of technical equipment, utilities, the non-functioning or partial non-functioning of the internet. The inconveniences as a result of drought, heat, cold, flooding, water shortage, power failure, storm, external as well as possible accidents are not the responsibility of the landlord. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible. Any costs incurred by the tenant in this regard will be reimbursed by us to the tenant on submission of specified invoices. If you still want to submit a complaint, it must be submitted to us in writing and with reasons within 14 days after leaving the holiday home. 

8. Departure and final cleaning. 
The tenant must place all waste in the appropriate waste container. The holiday home must be left in the following manner: - Leave the house wipe clean. - Everything washed clean, dried and put back in the cupboards. - The bed linen, duvet covers and linen folded on the bed. - Leave the dishwasher, dryer, washing machine and refrigerator clean and empty. - Do not leave any food in the cupboards. - Emptied the trash cans. Report any breakage and / or damage to the landlord. A cost of € 50 will be charged for each non - respected item above. 

9. Governing Law. 
All these terms and conditions and provisions from the rental agreement / house rules as well as any disputes arising therefrom are exclusively governed by Belgian law and will be settled by the court of Ghent. A copy of this agreement, completed and signed by the tenant, must be returned to the landlord within 5 days.
